7 June   1862           Swilling refused to requisition livestock near Pinos Altos, NM for the Confederacy, presumably from people he was familiar with from the mining area. The Confederate command found that Lieutenant Swilling had interfered with an order to procure animals and ordered Jack to report to headquarters to explain his conduct. A few weeks later Swilling was reported deserted from Fort Fillmore, NM.
2 July 6 1862     AZ     Military record carries the notation "Deserted from Fort Fillmore July 6, 1862" but historical accounts indicate Jack was captured by Union Forces. Its also possible Jack didn't want to return to Texas perhaps because he was till wanted for the murder in El Paso.

12     1876           Jack was a man of striking appearance, nearly six feet in height with broad shoulders and lengthy arms, and having the appearance of a men of great physical strength. He wore his black hair long, sweeping about his shoulders, while his carriage was erect and commanding. His clothing was always of ample size, which gave me the appearance of being even larger that he really was. (Personaly description by Ed. G. Wager, of Tip Top Arizona.)]
